Terms, Conditions & Policies of SHOWOFFS

TERMS & CONDITIONS APPLIES TO ALL ORDERS PLACED

IMPORTANT READ CAREFULLY BEFORE PLACING YOUR ORDER.

ALL ORDERS WILL HAVE THESE TERMS AND CONDITIONS APPLIED TO THEM.

NO EXCEPTIONS

 

    When placing an order with SHOWOFFS you are agreeing to all the terms & conditions set forth here in regards to payment terms, turn a round time frames, return and copyright / liability policies.

 

    PAYMENT TERMS ARE AS FOLLOWS

    We accept VISA, MasterCard or American Express for payment. No Checks or cash. A non-refundable 50% deposit is required on all orders. A credit card is required for insurance of timely delivery proposes as outlined below. Balance plus shipping is due upon completion. Final payment arrangements are to be made within 5 business days from date of first notification that your order has been completed and ready for shipment. If arrangements have not been made after this period of time we will/may charge your credit card on file and ship your order to the supplied shipping information provided on your work order. To avoid this from happening it is very important that you contact us immediately upon notification of completion to make payment arrangements unless these arrangements have been put in place at time of placing your order. Client or agent acting on clients behalf will be held responsible for balance due. AN INVALID CREDIT CARD will delay or result in you not receiving your product or services. NO PRODUCT WILL EVER BE SENT WITHOUT PAYMENT IN FULL!

 

    Should it come to SHOWOFFS is unable to collect on a balance within the time frame outlined above, We WILL bring suit to collect the debt with all court and attorney fees included.

 

    GIFT CERTIFICATES

    We accept VISA, MasterCard or American Express for payment for Gift Certificates. All Gift Certificates are redeemable within 2 years from date of issue. All Certificates require a non-refundable 50% deposit. Shipping charges are invoiced separately and are not included in the certificates value. If the recipient of the Gift Certificate neglects to redeem within one year we will contact the client to ask if they wish to redeem their full price or deposit for their own use. It is at our desecration if a Certificate will be honored beyond the expiration date.

 

 

    TURN AROUND TIME

    All orders will receive an art approval form by email or will be accepted as approved with an email or verbal approval. If you are rushing an order a Verbal approval will be considered "AS APPROVED". If we are rushing your order you may receive these with extra incurred shipping/postage cost applied to your final billing. General turn around time for drape orders are 6 to 8 weeks. This is dependent on time of year, as we tend be busier just before show season. If it is imperative that you have your order in a shorter time period we will try and accommodate that date with the understanding that you will be responsible for any extra incurred cost such as special order of material. overnight / special shipping on any correspondence, materials, shipping of finished product, change of order specifications that result in extra labor, material and or design time. If we cannot produce the product in a requested time frame, you will still be responsible for these costs. Request for a rush on your order will not guarantee that we be able to accommodate that request, yet we will try our best. In placing your order you will be financially responsible for any incurred charges. If you do not agree do not place your order.

 

    RETURN POLICY

    As all orders are custom designed & made. Therefore no return of any product is acceptable. It is your responsibility to inspect the finished product. You have 2 business days from date of delivery to notify SHOWOFFS of any problems with product. After two business days the order is considered accepted as is. Product can not have been displayed or used. If upon inspection it appears to have been used this will void any possible replacement of any defective product. This is up to our discretion. If there is any problem any problem found upon inspection we will do our best to fix it. As with replacement (return of defective item must be returned and (standard) shipping will be reimbursed if product is found to be in need of replacement) any other shipping method will be charged to client. Returns after the two business days inspection time period will not be accepted as replacement and will be considered a new order at full cost with the same terms and conditions as outlined here.

 

    *NOTE;

 

    Fabric finished size may vary and listed sizes are approximate of final product produced.

 

    Grommets, Velcro or stripes may change final sizing. We use standard sizing that will fit most any standard stall setup.

 

    If building your own frame work for your drapes we do not guarantee a perfect fit.

 

 

    COPYRIGHT POLICY

 

    **ALL DESIGNS CREATED BY SLY DESIGNS/SHOWOFFS ARE PROPERTY OF SLY DESIGNS/SHOWOFFS UNLESS A LOGO PACKAGE HAS BEEN PURCHASED.

 

    IT IS VERY IMPORTANT TO PURCHASE A LOGO DESIGN PACKAGE AT THE TIME OF DESIGN STAGES FOR ANY PRODUCT ORDERED.

 

    AS ANY ELEMENTS WE CREATE FOR ANY DESIGN/CLIENT ARE SUBJECT BECOMING PART OF OUR EXCLUSIVE CLIP ART COLLECTION AND ARE COPYRIGHTED BY SLY DESIGNS/SHOWOFFS WHEN THEY HAVE NOT BEEN PURCHASED AS LOGO.

    PER FILE FORMAT Option

 

    A $40 fee is applicable if you  would like to use the design as a Hi-Quality Black white sent via Email. This DOES NOT make the design yours until purchased.  It is a use of "fee" and does not imply "Rights" to the design, only a temporary Use per file sent. The $40 fee would apply to each file format requested.

 

    USE Release Package

 

    You may request the design as a package for use for advertising/promoting purposes in 4 file formats (EPS, PDF, & JPEG) as (1) Color and Black and White for $675, yet where elements from our exclusive clip-art collection has been used in your design it is not available as "LOGO" rights and does not imply "Rights" to the design.

 

    When a design is produced for a product SHOWOFFS offers, it does not imply rights to it but limited use rights.

 

    Logo Design Package is $895.00

 

    We will provide your new SHOWOFF Logo in 4 usable file formats, EPS, JPEG, PDF & PSD (Photoshop layers) All fonts used will also be included in your package.

 

    As Full color (Several versions), Gray scale and as Black and White

 

    Where elements have been supplied to SHOWOFFS by the client or others on the client’s behalf, the client shall indemnify and keep indemnified SHOWOFFS against all costs and claims arising out of any libelous matter or any infringement of copyright, patent, design or any other proprietary right contained in such artwork text, style or graphic.

    Unless specified by the client, SHOWOFFS in its absolute discretion shall print all works for digital printing in a resolution which in the considered opinion of SHOWOFFS is most appropriate for any particular application.

    It is understood any and all artwork supplied by client for reproduction, guideline, or production has been supplied to SHOWOFFS with NO copyright issues and the client will be held responsible for any claims of infringement and SHOWOFFS will not be held responsible for any copyright infringement. Art work supplied is supplied to SHOWOFFS with all useful rights applied.

    Any alteration or deviation from above specifications involving extra costs will become an extra charge over and above final cost. All agreements contingent upon strike, accidents or delays beyond our control. Insurance will be applied to all shipments of finished products.
